5.b. Chatbot and AI Interactions
Our Services may include interactions with an AI-powered chatbot designed to assist you in navigating the website, answering questions, and providing general information. By using these features, you acknowledge and agree that:

  2. Information shared with the chatbot will be handled in accordance with our Privacy Policy but may not be encrypted due to using third-party technologies (Intercom, Telegram, and others).
  3. Avoid sharing sensitive or confidential information through the chatbot.VisaNow.AI does not guarantee the accuracy or completeness of the chatbot's responses.

5.c. Notifications and Unauthorized
UseYou agree to notify VisaNow.AI immediately of any:
  1. Unauthorized access to your account or breach of security, such as lost, stolen, or compromised login credentials.
  2.Suspicious activity or misuse of the Services that comes to your attention.

5.d. Liability Disclaimer
VisaNow.AI is not responsible or liable for:
  1. Unauthorized access to your account resulting from your failure to protect your login credentials.
  2. Any loss or damage arising from reliance on information provided by the chatbot or AI systems.
  3. Interruptions, errors, or malfunctions related to account access or chatbot interactions.

5.e. Account Termination
We reserve the right to suspend, terminate, or restrict access to your account at our sole discretion, with or without notice, for reasons including but not limited to:

  2. Use of the account or Services for unlawful or prohibited activities.
  3. Providing false or misleading information during registration or while using the Services.

6. PURCHASES AND PAYMENT

VisaNow.AI accepts payments via Visa, Mastercard, American Express, and other approved payment methods.

  2. You authorize us to charge your payment method for fees associated with the Services.
  3. Fees are non-refundable unless otherwise stated in our refund policy.

Recurring Charges:
If you opt for recurring services, you authorize us to automatically charge your payment method until you cancel.

7. PROHIBITED ACTIVITIES

You may not access or use the Services for any purpose other than that for which we make the Services available. The Services may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by VisaNow.AI.

As a user of the Services, you agree not to engage in the following prohibited activities:

    - Impersonate another user or person, or use the username of another user without proper authorization.
  5. Illegal Activities: 
    - Use the Services to engage in any unlawful, abusive, or otherwise objectionable activities, including but not limited to promoting violence, discrimination, or harassment.
  6. Content Misuse: 
    - Upload, transmit, or share viruses, Trojan horses, spyware, or other harmful or disruptive software or code.
    - Modify, adapt, translate, decompile, disassemble, or reverse-engineer any portion of the Services.

10. GUIDELINES FOR REVIEWS

    - VisaNow.AI reserves the right to remove any Advertisement that we determine, in our sole discretion, to be inappropriate, misleading, or in violation of our policies.

By engaging with Advertisements on our platform, you acknowledge and agree that any reliance on the content of such Advertisements is at your own risk.

TO THE FULLEST EXTENT PERMITTED BY LAW, VisaNow.AI DISCLAIMS ALL LIABILITY FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, OR OTHER DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES.
OUR LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO VISANOW.AI IN THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

  3. Your violation of any third-party rights, including intellectual property rights or privacy rights.
  4. Any violation of applicable laws or regulations.

VisaNow.AI reserves the right, at your expense, to assume exclusive defense and control of any matter subject to indemnification. You agree to cooperate fully with us in asserting available defenses.

These Terms and your use of the Services are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.

  3. Consumer Protections:
    - If you are a resident of another country, you may have additional rights under the laws of your country. However, to the extent permitted by law, you agree that such rights will not alter the application of these Terms as governed by U.S. law.These Terms and your use of the Services are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.

18. DISPUTE RESOLUTION

Informal NegotiationsBefore initiating any legal action, you and VisaNow.AI agree to attempt to resolve disputes informally for at least 30 days. To initiate informal negotiations, please contact us in writing at dt@visanow.ai and 900 W Temple St., Unit 628, Los Angeles, CA 90012.Binding Arbitration

If a dispute cannot be resolved informally, it will be submitted to binding arbitration as follows:
  1. Arbitration Forum and Rules:
    - The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be conducted in English and take place in San Francisco, California.
  2. Individual Arbitration Only:
    - You and VisaNow.AI agree to waive the right to participate in any class action or representative proceeding. Arbitration will be conducted on an individual basis.

Exceptions to Arbitration
The following disputes are exempt from arbitration:
    - Claims related to intellectual property rights or allegations of piracy.
    - Claims seeking injunctive relief.

Small Claims Court:
If your dispute qualifies, you may file your claim in small claims court instead of arbitration.

19. TERM AND TERMINATION

Termination by User:
You may terminate these Terms at any time by discontinuing use of the Services and deleting your account.Termination by VisaNow.AI:
We reserve the right to terminate or suspend your access to the Services at any time, with or without notice, for any of the following reasons:
  1. Breach of these Terms.
  2. Engaging in prohibited activities as outlined in these Terms.
  3. Failure to pay any fees owed for the use of the Services.

Effects of Termination:
  - Upon termination, your rights to access and use the Services will cease immediately.
  - Certain provisions, such as Governing Law, Dispute Resolution, and Disclaimer, will survive termination.
